Please read these Terms and Conditions ("Terms") carefully before installing or using POD Master (the "App", "Service") operated by MNB Apps ("we", "us", "our"). By installing, accessing, or using POD Master you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you ("Merchant", "you") and MNB Apps governing your use of the POD Master Shopify application. Your continued use of the Service after any modifications to these Terms constitutes acceptance of those changes.

POD Master is a Shopify application that enables merchants to offer custom print-on-demand products directly within their Shopify store. The App provides:

The Service is provided as a software-as-a-service (SaaS) application hosted on Shopify's platform and accessed through the Shopify Admin.

Access to POD Master is provided through your existing Shopify merchant account. You do not create a separate account with MNB Apps; authentication and identity are handled entirely by Shopify.

POD Master is offered under a subscription model with a 7-day free trial available to all new users. The following paid plans are available:

All subscription fees are billed through Shopify's recurring application charge system and appear on your Shopify invoice. Billing is processed on a monthly basis and begins automatically at the end of the 7-day free trial period unless you cancel prior to the trial expiration.

Subscription fees are non-refundable except where required by applicable law or at our sole discretion. You may upgrade or downgrade your plan at any time through the App settings; charges will be prorated according to Shopify's billing policies. We reserve the right to modify pricing with reasonable notice, which will be communicated via the App or email.

5. Acceptable Use

You agree to use POD Master only for lawful purposes and in accordance with these Terms. You must not:

We reserve the right to suspend or terminate your access to the Service immediately and without notice if we determine, in our sole discretion, that you have violated these acceptable use provisions.

6. Intellectual Property

Your Content: You retain full ownership of all designs, images, text, and other materials you upload or create using the App ("Your Content"). By using the Service, you grant MNB Apps a limited, non-exclusive, royalty-free license to host, display, and process Your Content solely to the extent necessary to provide the Service to you. You represent and warrant that you have all rights, licenses, and permissions necessary to upload and use Your Content.

Our Platform: MNB Apps retains all right, title, and interest in and to the POD Master application, including its software, design, trademarks, logos, and all related intellectual property. Nothing in these Terms grants you any right or license in or to our intellectual property beyond the limited right to use the Service as permitted herein. The "POD Master" name, logo, and associated marks are proprietary to MNB Apps.

POD Master integrates with and depends upon third-party services, most notably:

We are not liable for any loss or damage arising from your use of, or reliance on, any third-party services. We encourage you to review the terms and privacy policies of all third-party services you use in connection with POD Master.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MNB Apps, its officers, directors, employees, agents, licensors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of or inability to use the Service.

In no event shall MNB Apps' total cumulative liability to you for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the total fees paid by you to MNB Apps in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, MNB Apps' liability is limited to the greatest extent permitted by applicable law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MNB APPS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

MNB Apps does not warrant that the Service will be uninterrupted, error-free, completely secure, or free of viruses or other harmful components. We do not warrant that any defects in the Service will be corrected, or that the Service will meet your specific requirements or expectations.

10. Indemnification

You agree to indemnify, defend, and hold harmless MNB Apps and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

We reserve the right, at our own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

11. Termination

By You: You may terminate these Terms at any time by uninstalling POD Master from your Shopify store. Uninstalling the App will cancel your active subscription in accordance with Shopify's billing policies. No partial-period refunds are provided unless required by law.

By Us: We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms, non-payment, or if we determine that continued provision of the Service creates legal or commercial risk to MNB Apps.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and indemnification — shall survive.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to personal jurisdiction in such courts.

Before initiating formal legal proceedings, you agree to first contact us at podmaster@mnbapps.com and attempt to resolve the dispute informally for a period of at least thirty (30) days.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, notify you via the App or the email address associated with your Shopify account.

Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Service and uninstall the App.
